Terms of Service

Welcome to FastPunch. By accessing or using our application, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By creating an account or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

2. Description of Services

FastPunch provides voice-first punch list management tools for construction and fieldwork professionals, including but not limited to:

• Voice-to-text capture and transcription
• Project and task management
• Photo capture and AI analysis
• PDF and Excel export
• Cloud synchronization
• Live project sharing

3. Subscription Terms

3.1 Free Trial

New users may access a free trial of Premier features for 14 days, followed by a 7-day Pro trial. No credit card is required for the trial.

3.2 Paid Subscriptions

After the trial period, continued access to premium features requires a paid subscription. Subscriptions are billed through Apple's App Store and renew automatically unless cancelled at least 24 hours before the renewal date.

3.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.

3.4 Refunds

Refund requests are handled by Apple according to their App Store refund policies. We do not process refunds directly.

4. Enterprise Accounts

Enterprise subscriptions are managed separately through Stripe and may include additional terms as specified in your enterprise agreement. Enterprise billing is per-seat, per-month volume pricing. By accepting an enterprise invite, you authorize your company to be billed for your seat.

4.1 Admin Authority

Enterprise administrators can invite and remove team members, assign roles, view organization-wide project data, and configure data retention policies. Administrators act on behalf of the organization.

4.2 Procore Integration

If you connect your Procore account, FastPunch will sync project and item data via Procore's API. This integration is governed by Procore's Terms of Service and Privacy Policy in addition to these Terms.

4.3 Data Deletion

Enterprise administrators may request organization-wide data deletion by contacting support. Individual enterprise users cannot delete their own accounts independently — removal must be initiated by an administrator or by contacting support.

5. User Content

5.1 Ownership

You retain ownership of all content you create using our Services, including voice recordings, project data, photos, and notes.

5.2 Photo Processing & Security

When you upload photos to FastPunch:

• Metadata removal: GPS coordinates, device identifiers, camera model information, and original timestamps are automatically stripped from every photo. Only the image content is retained.
• Secure delivery: Photos are served through time-limited signed URLs that expire after 5 minutes. No permanent, publicly-accessible photo links exist.
• Access logging: Every photo view is logged for security auditing.
• Retention: Photos are retained only while your project is active and are automatically deleted within 90 days of project completion.

5.3 License

You grant us a limited license to store, process, and transmit your content solely to provide and improve our Services. This license does not extend to selling, licensing, or publicly displaying your content.

5.4 AI Processing

Voice data may be processed by on-device AI or sent to cloud AI services for transcription and analysis. By using AI features, you consent to this processing. You may opt out of cloud AI processing in Settings.

6. Acceptable Use

You agree not to:

• Use the Services for illegal purposes
• Attempt to access, tamper with, or use non-public areas of the Services
• Interfere with or disrupt the Services
• Reverse engineer or decompile any part of the Services
• Share account credentials with unauthorized users
• Upload malicious software or content

7. Data and Privacy

Your use of the Services is governed by our Privacy Policy, which details our data handling practices including photo security, metadata stripping, and access logging. FastPunch employs JWT authentication with 24-hour token expiry, rate limiting, CORS restriction, and role-based access control to protect your data.

8. Intellectual Property

FastPunch and its original content, features, and functionality are owned by APRJ and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with these Terms or the Services.

10. Warranty Disclaimer

The Services are provided "as is" without warranties of any kind, either express or implied. While FastPunch implements industry-standard security measures including JWT authentication, rate limiting, encrypted storage, and EXIF metadata stripping, we do not warrant that the Services will be uninterrupted or error-free.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use after changes constitutes acceptance.

12. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify affected users within 72 hours of discovery where required by law, and will take reasonable steps to mitigate harm.

13. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
